Commentary by Attorney Michael Grossman

While the cause of the crash is not confirmed, authorities say the truck driver told them the truck went over a “bump” before then fishtailing and losing control. Just to be clear, it’s not my place to say if that’s true or not. I’ll leave that up to the evidence to say for itself. But it reminded me of a recent truck accident our firm handled, and it’s a good example of why seemingly small details like that should be taken seriously.

In that case, a truck lost traction, crossed the center line, and crashed head-on into a woman’s vehicle. The truck driver in that case claimed it was due to hitting a patch of water. But our investigations showed why that was such a ridiculous claim. For one, there wasn’t nearly enough water on the road at the time of the crash to cause problems for any driver going at appropriate speeds. Unsurprisingly, we were able to prove that driver had been going too fast even for dry conditions, let alone the wet conditions the driver was trying to blame the crash on.

So why do drivers even try to blame factors like that? Well, they’re usually just counting on no one asking questions. It would surprise people how often drivers and companies get off scot-free just because no one took their excuses seriously. As they say, you give an inch, they’ll take a mile. That’s why clear evidence is absolutely crucial after any crash. Whether some bump in the road led to a crash or not, letting the facts speak for themselves leaves no room for mistakes, doubts, or excuses.
