Commentary by Attorney Michael Grossman

When a single-vehicle crash happens in the early morning hours, there are often more questions than answers. Without witnesses, authorities must rely on physical evidence to piece together what happened. The problem is that if investigators don’t have the necessary time, tools, or training, key details can slip through the cracks. That’s why it’s important to ask some key questions.

Did investigators take the time to fully analyze all possible factors? If authorities were stretched thin or working with limited resources, they may have been unable to conduct a thorough reconstruction. Did they carefully document roadway conditions, potential hazards, or mechanical failures that could have contributed to the crash?

Did they examine the vehicle for possible defects? People often assume driver error in single-vehicle accidents, but issues like brake malfunctions, steering failures, or seatbelt and airbag defects can sometimes play a role. Was the vehicle properly inspected to rule out these possibilities?

Did they collect and preserve all electronic evidence? The truck’s Engine Control Module (ECM) may contain vital data on speed, braking, and steering before the crash. Additionally, cellphone records, GPS data, or nearby security cameras could offer further insights. Have authorities taken steps to secure this information?

Families sometimes find that authorities are able to come up with sensible, satisfactory answers. That’s usually a sign they did good investigations. However, if things aren’t adding up, that can be a family’s sign that there needs to be a second set of eyes looking at things to ensure nothing important slips through the cracks.
