Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope the injured driver receives proper care and that investigators are fully examining the circumstances surrounding the incident. A vehicle leaving the roadway and overturning on a rural route like F.M. 2495 requires more than a brief explanation. To understand what happened near Colombia Drive, we need to ask three critical questions.

First, did the authorities thoroughly investigate the crash? A single-vehicle rollover suggests a possible loss of control, but it’s important to determine why the vehicle left the roadway. Were there any hazards present — such as sharp curves, poor lighting, uneven pavement or roadside drop-offs — that may have contributed? Was the road marked appropriately, and were conditions (such as wet or icy pavement) documented? A complete scene analysis is necessary to identify whether road design or conditions may have played a role in the incident.

Second, has anyone considered whether a vehicle defect may have contributed to the crash or its severity? The 2013 GMC Terrain involved in this crash should be carefully inspected. Issues such as brake failure, steering problems or suspension faults could all result in a sudden loss of control. Additionally, because the vehicle overturned, it’s critical to examine whether its structural systems — including roof strength and restraint systems — performed as they should have. These types of evaluations are essential in assessing whether mechanical issues or design factors affected the outcome.

Finally, has all the electronic and digital data related to the crash been collected? The GMC Terrain is likely equipped with an engine control module capable of recording pre-crash data such as speed, throttle position, brake application and steering input. This information can help clarify whether the driver made any corrective attempts before the crash and whether the vehicle responded appropriately. If GPS data or video footage from nearby properties is available, that can also help reconstruct the vehicle’s movement. This type of evidence is time-sensitive and should be secured promptly.

Single-vehicle crashes like this often appear straightforward, but that doesn’t mean the explanation is simple. A man suffered serious injuries, and only a complete investigation — one that looks at roadway conditions, vehicle performance and available data — can determine whether the crash was truly unavoidable or if it could have been prevented. That clarity is not just useful. It’s necessary for everyone affected.
