Daingerfield, TX — January 28, 2024, John Alvin Mitchell was injured in a pedestrian versus car accident shortly after 7:00 p.m. along Linda Drive.
According to reports, the accident took place on Linda Drive just south of the Center Street intersection.

The causal factors that led to the accident remain unconfirmed right now. Officials indicate that 63-year-old John Alvin Mitchell was on foot allegedly attempting to cross Linda Drive from east to west. While doing so, he was reportedly struck by a northbound Toyota Tacoma. Mitchell incurred suspected severe injuries as a result of the accident; Mitchell was transported to a local medical facility by EMS in order to receive treatment. No other injuries have been reported.

Additionally, I’ve seen statements from authorities saying they believe alcohol played a role in this accident, and the TABC may be looking into a local alcohol provider for possibly contributing to the crash through over-service of alcohol. Here’s why that’s important.
Texas law acknowledges that it’s not just an accident itself causing injury or death that warrants attention but also any negligent action that set that chain of events into motion. When a bar, restaurant, liquor store, or similar venue unlawfully over-serves someone, they’re creating a situation which could predictably lead to harm. As such, when over-service leads to people getting hurt, the alcohol provider is on the hook for the harm resulting from those actions.
Frankly, it’s not often authorities are so proactive about finding a negligent alcohol provider after an accident. When they do take immediate actions, it’s usually because something particularly serious caught their attention. I’m curious what that could have been here.
