Commentary by Attorney Michael Grossman

When a vehicle crashes into the back of a parked flatbed trailer, the key question is whether the trailer was legally and safely parked. People may assume the driver simply lost control, but in my experience, trailer visibility, parking location and roadway design often play a major role in these crashes.

One major factor to consider is whether the flatbed trailer was clearly visible. Large commercial trailers, especially flatbeds, can be difficult to see if they lack proper reflective markings or lights. At night or in poor lighting, an unmarked trailer can blend into the surroundings, making it nearly invisible to approaching drivers. Investigators should determine whether the trailer had the required reflective tape, lighting and hazard signals to alert oncoming traffic.

Another critical issue is where and how the trailer was parked. Was it in a designated parking area, or was it stopped in a lane of travel or on the shoulder? If it was legally parked, was it positioned in a way that gave drivers enough time to react? Many crashes like this happen because trailers are left in unsafe locations, creating unnecessary hazards for other motorists.

It’s also important to examine why the vehicle veered off the road in the first place. Were there road conditions — such as debris, sharp curves or poor signage — that made it more likely for a vehicle to leave the roadway? Investigators should review surveillance footage, roadway design and witness statements to determine what led to the crash.

At this stage, there’s still a lot we don’t know about this collision. But what is clear is that investigators need to look beyond the assumption that the driver was at fault. If authorities don’t examine trailer visibility, parking safety and roadway conditions, they may overlook key details that explain why this crash happened.
