Commentary by Attorney Michael Grossman

Single-vehicle wrecks like this can be rather complex, as they don’t often get the attention they deserve. In fact, authorities can sometimes be more focused on blaming someone than actually getting all the facts. That’s why there are key questions that I always keep in mind, and they can be helpful for gauging how a crash investigation is being handled.

1. How Effort Are Authorities Putting Into the Investigation?

Rushed investigations may overlook uncommon or subtle issues, and authorities aren’t always dedicating a lot of time to single-vehicle wrecks. If they’re seen as a low priority, officers may be pulled to other jobs before they’ve had a chanced to really dig into the details. Things like poorly designed roadways, debris, or weather-related hazards, for example, can be outside a driver’s control. But if they don’t actually get attention, they’re likely to slip through the cracks.

2. Did Authorities Look for Possible Vehicle Defects or Maintenance Issues?

Problems such as faulty brakes, steering malfunctions, or worn tires can cause a driver to lose control. Additionally, faulty seatbelts or airbags can result in serious injuries that otherwise would have been prevented. Drivers may not realize these issues exist until it’s too late, making a thorough vehicle inspection essential. However, investigations into complex defects can require extensive experience and state-of-the-art tools departments don’t always provide to officers.

3. Have Authorities Gathered and Examined All Electronic Data?

Data from a vehicle’s Electronic Control Module (ECM) and cellphone records can offer vital insight into the moments leading up to the crash. Additionally, video from other vehicles, traffic cams, nearby businesses, or even residences can help tremendously. It would shock people to see how often authorities overlook what would seem to be obvious pieces of evidence.

By asking these questions, it gives authorities an opportunity to provide answers. If those answers make sense and alleviate doubts, it’s probably because authorities did a good job. But if the answers aren’t adding up, then that may be a sign the crash would do better with a second set of eyes.
