Commentary by Attorney Michael Grossman
Authorities did not mention pending charges or citations, but they said the vehicle may have been speeding. A claim like that is always important to consider, especially considering how often folks automatically blame pedestrians. These situations don’t simply come down to right-of-way, as folks tend to think. For example, if someone is clearly visible and far away enough for a reasonably prudent driver to avoid, the driver has a responsible to avoid them. They don’t get a blank check to run people down just because they have the right-of-way.
To be clear, I’d need to see a lot more information to make any kind of conclusions about this specific accident. My hope is authorities at least addressing possibilities surrounding the driver’s behavior is a sign they’re being thorough and considering this from all angles. Otherwise, they might leave a family with unanswered questions.
