Commentary by Attorney Michael Grossman

This fatal crash underscores the importance of a thorough investigation to determine the factors contributing to the collision. While initial reports highlight certain conditions, such as the bicyclist wearing dark clothing and lacking bike lights, it’s essential to ensure all aspects of the incident are examined. To provide a complete understanding, investigators should focus on three key questions.

First, did authorities conduct a thorough investigation of the crash scene? Given that the bicyclist was reported to be riding in the middle of the service road, it’s critical to assess the road’s lighting, visibility and overall condition at the time of the crash. Were there streetlights or reflective markers that might have helped improve visibility? Were weather or road surface conditions, such as wet or uneven pavement, factors? Additionally, were the driver’s actions, such as speed and lane position, documented through witness statements or other evidence? A comprehensive analysis of the scene is essential to reconstructing the events.

Second, has anyone considered whether a mechanical issue in the Ford sedan or the bicycle may have contributed to the crash? While the bicyclist’s lack of lights and dark clothing are highlighted as contributing factors, it’s also important to explore whether the Ford’s headlights, brakes or other systems were functioning properly at the time. Similarly, was the bicycle in good working order, or could mechanical failure have contributed to its placement on the road? Preserving both vehicles for inspection is crucial to identifying any mechanical issues that may have played a role.

Finally, has all electronic data related to the crash been collected? The Ford sedan’s engine control module (ECM) could provide valuable information about the vehicle’s speed, braking and steering inputs leading up to the collision. This data can help determine whether the driver attempted evasive maneuvers upon seeing the bicyclist. Additionally, nearby traffic or security cameras, if available, might offer video evidence of the collision or the events leading up to it. Cell phone records for the driver should also be reviewed to rule out distraction as a contributing factor.

While certain aspects of the crash, such as low visibility due to the bicyclist’s dark clothing and lack of lights, are highlighted, a thorough investigation must consider all possible factors to provide a complete understanding of what occurred. By addressing these three questions, authorities can work toward providing clarity and accountability for those impacted by this tragic incident.
