Jeronimo Perez, 1 Injured in Truck Accident on U.S. 259 in Upshur County, TX

Officials indicate that, for reasons yet to be confirmed, a southbound Freightliner occupied by a 26-year-old man with a trailer in tow failed to properly control its speed. This resulted in a rear-end collision between the front of the truck and the back of the Hyundai. The impact forced the passenger vehicle off of the right side of the road where it cam to a stop in a bar ditch after hitting a tree. The truck also veered off of the road and lost its load of metal coils, overturning and coming to a stop resting on its roof.

Perez suffered reportedly serious injuries as a result of the wreck; the man from the truck sustained moderate injuries, as well, according to reports. They were each transported to local medical facilities by EMS in order to receive necessary treatment. Additional details pertaining to this incident are not available at this point in time. The investigation is currently ongoing.

Commentary by Attorney Michael Grossman

When accidents like this happen, it’s easy for people to assume they stem from simple mistakes or misjudgments. However, based on my experience, crashes involving large trucks often involve multiple factors that need thorough investigation. This collision is no exception.

At first glance, it appears that the driver of the Freightliner may have failed to control the truck’s speed, leading to a rear-end collision with the Hyundai Santa Fe. Trucks carrying heavy loads, like the metal coils in this case, require significantly longer stopping distances, and any failure to adjust speed appropriately can result in severe consequences. Investigators will need to determine whether the truck driver was distracted, fatigued, or simply failed to maintain a safe following distance.

Driver fatigue is a particularly important issue in cases like this. Long hours on the road, irregular sleep schedules, and pressure to meet delivery deadlines can cause commercial truck drivers to become dangerously tired behind the wheel. Fatigued driving can impair reaction times and decision-making abilities, making it difficult for drivers to safely control their vehicles. It’s crucial that investigators look into the driver’s hours-of-service records and company policies to determine whether fatigue may have played a role in this crash.

If the truck was operating under a commercial company, it’s important to examine whether the company followed proper safety protocols and ensured its drivers were adequately trained. Commercial truck drivers need to be fully aware of the stopping distance required when carrying heavy loads, and trucking companies have a duty to ensure their vehicles are well-maintained and that loads are properly secured. Any lapses in these areas could mean the company shares responsibility for the crash.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
