Commentary by Attorney Michael Grossman
An explosion is challenging enough to investigate on its own, but combine that with the fact this was a work-related incident could present even more significant challenges. Texas has the most complex work fatality laws of any other state in the country. Despite what people may think, there is not always an automatic path for getting a victim’s loved ones benefits. This can result in a significant legal maze that requires unique legal strategy and a mountain of evidence to properly navigate.
That’s why it’s important not to just assume authorities have everything handled. Their priorities may not align with the needs of a worker’s loved ones. It may take steps from the families themselves to ensure someone is looking out for their best interests as steps are taken to uncover the cause of the accident. I see no reason right now why this incident would be an exception.
