Commentary by Attorney Michael Grossman
When a motorcyclist loses their life in an accident, it’s easy for some to assume they were at fault due to the perception of motorcycles as more vulnerable and less visible. However, in my experience, crashes involving motorcycles and larger vehicles are rarely simple, and a proper investigation is essential to understand exactly what happened. This collision involving a work truck and a motorcycle raises several questions about the circumstances and contributing factors that may not be immediately obvious.
One key aspect investigators will need to examine is the actions of both the truck driver and the motorcyclist in the moments leading up to the collision. Factors like visibility, potential distractions, speed, and adherence to traffic laws play a significant role in incidents involving vehicles of vastly different sizes and maneuverability. Motorcycles are often at a disadvantage in terms of visibility, and drivers of larger vehicles have a responsibility to stay especially vigilant around them. Likewise, investigators will look at whether any mechanical issues with either vehicle or environmental factors may have contributed.
If the work truck involved was being operated on behalf of a commercial company, that company’s role could come into question as well. Commercial entities have an obligation to ensure that their vehicles are roadworthy and that drivers are adequately trained, especially when it comes to maneuvering near smaller, more vulnerable road users like motorcyclists. Any oversight or negligence in these areas could potentially mean the company shares responsibility for the outcome of the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
