Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my first thought is that the injured passenger and his loved ones deserve clear answers about what happened. A collision caused by a failure to yield raises serious questions, and in my experience, these incidents often involve more than just driver error. Before any conclusions can be reached, three key areas need further investigation.
First, did authorities conduct a thorough investigation? While the Dodge Charger driver was cited for failing to yield, it’s important to determine whether any external factors contributed to the crash. Were visibility issues, such as poor lighting or obstructed signage, a factor in the driver’s ability to see oncoming traffic? Were road conditions, such as wet pavement or debris, affecting the vehicle’s ability to turn safely? Did investigators check for any nearby traffic cameras or witness statements to confirm the sequence of events? A full accident reconstruction is necessary to ensure all contributing factors are considered.
Second, has anyone looked into whether a vehicle defect contributed to the crash? The Dodge Charger is a modern vehicle, but mechanical failures — such as steering malfunctions, brake issues or delayed acceleration — could have played a role in preventing the driver from completing the left turn safely. Additionally, the severity of the passenger’s injuries raises questions about whether the vehicle’s crashworthiness systems — such as seat belts, airbags and side-impact protection — functioned as expected. A forensic inspection of both vehicles is necessary to rule out any mechanical or safety failures.
Finally, has all available electronic data been collected? Both the Dodge Charger and the Nissan Murano likely have engine control modules (ECMs) that store key data such as speed, braking and steering inputs leading up to the crash. Retrieving this data could help determine whether the Dodge driver attempted to stop or accelerate out of the way, or if the Nissan driver had time to react before impact. Additionally, authorities should check for any nearby surveillance or traffic cameras that may have captured footage of the crash. Phone records should also be reviewed to determine whether distraction played a role.
At the end of the day, a passenger suffered serious injuries, and he deserves to know exactly what happened. A full and thorough investigation is the only way to ensure that no key details are overlooked. If any of these three questions remain unanswered, the victim and his family simply don’t have the full story.
