Commentary by Attorney Michael Grossman
When a car crashes into the back of a semi-truck, many people assume the driver of the smaller vehicle must have been at fault. While that may turn out to be the case, experience has taught me that these crashes often have more to them than meets the eye. The real question isn’t just what happened, but why it happened.
One of the first things investigators should determine is whether the truck was moving or stopped at the time of the crash. If it was stopped, was it in a travel lane or on the shoulder? Was it properly marked with hazard lights or reflective warning devices? A stopped or slow-moving truck without adequate visibility measures can be nearly impossible to see in low-light conditions, turning it into a deadly obstacle for approaching drivers.
Even if the truck was moving, visibility remains a major issue. Underride crashes — where a smaller vehicle goes beneath the back of a trailer — are particularly dangerous and often fatal. Investigators should determine whether the truck had a properly maintained underride guard, as required by federal regulations. If that equipment was missing or defective, that could have contributed to the severity of the crash.
At this stage, it’s impossible to say with certainty what caused this wreck, but that’s exactly why a full investigation is necessary. If authorities stop at surface-level conclusions, they may overlook critical details that determine who is truly accountable. A crash like this deserves more than just assumptions: it requires real answers.
