Commentary by Attorney Michael Grossman

My hope is authorities have been more thorough than these public statements suggest. I can’t begin to count how many folks I talk to involved in a single-vehicle wreck who have the same problem: authorities simply moved on without giving them the attention they deserved.

Unfortunately, not a lot of departments prioritize accident reconstruction, and single-vehicle wrecks are just about on the bottom rung when it comes to what kind of crashes get attention. As a result, authorities tend to only investigate surface-level details like road conditions, intoxication, and distraction. Those are important, of course, but what about manufacturing defects? Brake failure? Road design flaws? Missing signage or lighting? While less common, these factors cause wrecks, and they need to be addressed. Without the right tools or experience though, they easily slip through the cracks.

That’s why some departments understand their shortcomings and have independent accident reconstructionists pick up the slack. I’ve found independent investigators to consistently be far more thorough than the authorities when it comes to getting answers, which is why I rarely take early reports like these at face value. It remains to be seen if any such efforts have been made to get answers here.
