UPDATE (September 6, 2024): Recent reports have been released which clarify some of the details of what occurred leading up to and during this accident. According to these reports, 67-year-old James Roberts was traveling in a southbound 18-wheeler with a trailer loaded with rocks on S.H. 159. There was a fuel tanker at a stop in the northbound lane waiting for southbound traffic to clear so it would make a safe left turn. Officials indicate that a northbound 18-wheeler also hauling a load of rocks allegedly swerved around the fuel tanker in an attempt to avoid a collision, entering the oncoming lane of traffic. This resulted in a collision with the northbound truck.

Roberts suffered fatal injuries as a result of the wreck. The man who had been behind the wheel of the other truck sustained injuries, as well, and was taken to a medical center for treatment. No additional details are currently available. The investigation remains ongoing.

Commentary by Attorney Michael Grossman

When accidents like this happen, it’s easy for people to assume they are the result of simple mistakes or bad timing. However, based on my experience, crashes involving large trucks often have deeper, more complex causes that require thorough investigation.

The collision between two 18-wheelers in this incident raises several questions. Truck crashes can be the result of many factors beyond driver error, such as mechanical failures, improper maintenance, or even external elements like road conditions. Investigators will need to look closely at the events leading up to the wreck, including the possibility of brake issues, tire blowouts, or problems with the trucks’ load balance. Additionally, whether one or both drivers followed necessary safety protocols is a critical area to explore.

If either of the trucks was operating for a commercial trucking company, it’s important to consider the company’s role in ensuring its vehicles and drivers are prepared for the road. Companies are responsible for maintaining their trucks, ensuring drivers follow hours-of-service rules to prevent fatigue, and providing adequate training. Any lapses in these responsibilities could suggest the company shares liability for the accident.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
