Commentary by Attorney Michael Grossman
With charges being recommended here, people may think this is all open-and-shut. In my experience, though, there could be more to the story. I’ve handled hundreds of alcohol-related accident cases, and there’s often an accomplice who may also need to be held responsible for their role in the accident: a negligent alcohol provider.
Simply put, if a bar, restaurant, liquor store, or other establishment serves someone who is obviously intoxicated, it exposes them to potential criminal investigations, fines, suspended licenses, and liability for the injuries resulting from the intoxication.
Unfortunately, this isn’t always a priority for police investigators. I can’t count how many times victims and families asked us to look into a serious drunk driving crash, and our investigations revealed a negligent bar that authorities completely overlooked. Maybe they’ve been more thorough here, but there would have to be more evidence to say for sure one way or another.
