Commentary by Attorney Michael Grossman
When people hear about crashes like this one, it’s easy for them to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks often require thorough investigations to understand all contributing factors.
First, it’s crucial to determine what caused the Malibu to veer off the highway. Was the driver distracted, experiencing a medical emergency, or dealing with some mechanical failure? Gathering data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements will be crucial in piecing together the events leading to this accident.
Next, the positioning and visibility of the parked 18-wheeler must be scrutinized. Was the truck properly parked on the shoulder with all necessary safety measures in place, such as hazard lights and reflective triangles, to alert oncoming traffic? Ensuring that disabled vehicles on highways are correctly marked and positioned can prevent such tragic incidents.
Additionally, the role of the trucking company needs to be examined. Did the company ensure that the truck was regularly maintained and that the driver was adequately trained in emergency protocols? Trucking companies have a responsibility to ensure their vehicles and drivers adhere to safety regulations, particularly when dealing with breakdowns on busy highways.
Furthermore, the actions of the second 18-wheeler involved in the secondary collision also warrant investigation. Understanding whether this vehicle was following at a safe distance and whether its driver had enough time to react to the unfolding situation on the road will be essential in painting a complete picture of the accident.
Investigations must go beyond the immediate crash scene to uncover the full story. This includes looking into the truck drivers’ logs, evaluating their driving histories, and possibly consulting with accident reconstruction experts. A comprehensive investigation can help ensure that all responsible parties are held accountable.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Whether through obtaining vital evidence or, if necessary, conducting an independent investigation, it’s crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
