Commentary by Attorney Michael Grossman

When accidents like this one occur, it’s tempting to assume they result from simple driver error or a momentary lapse in judgment. However, in my experience handling cases involving large commercial vehicles, such incidents often stem from a far more complex set of factors. While it remains to be determined why Mr. Hopson’s vehicle collided with the rear of the 18-wheeler, it’s worth investigating whether mechanical issues, operational practices, or regulatory noncompliance could have played a role in the crash.

One question worth examining is whether the truck and trailer were properly outfitted with functional and visible safety equipment, such as reflective tape, tail lights, and underride guards. These features, required by law, are intended to improve visibility and mitigate the severity of rear-end collisions. If any of these elements were missing or defective, they may have contributed to Mr. Hopson’s inability to stop or avoid the crash in time.

Additionally, it is important to scrutinize the trucking company’s role in the incident. Federal regulations require companies to maintain their vehicles in a roadworthy condition and to ensure drivers are well-trained and adhering to safety protocols. For instance, was the truck driver operating within hours-of-service limitations to avoid fatigue? Were the truck and trailer inspected and maintained according to schedule? Neglecting these responsibilities can create unnecessary hazards not only for the truck driver but also for everyone sharing the road.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
