Midlothian, TX — May 5, 2024, James Groom was killed as the result of a car versus pedestrian accident at around 10:30 p.m. on U.S. 67.

According to initial details from authorities, the accident happened in the area of U.S. Highway 67 and Shiloh Road.

Investigators said that 38-year-old James Groom was on foot and walking on the southbound side of the U.S. 67 service road. While there, a southbound vehicle struck Groom, resulting in fatal injuries. The driver is not said to be facing charges at this time. Investigations are ongoing.

I certainly can’t speculate about what did or didn’t happen here. Folks tend to think pedestrian accidents are simple cases of who had the right-of-way. That’s an important detail, but things can become complex rather quickly. It’s important there are measures in place to contend with those potential challenges so nothing important slips through the cracks.

For example, I had a family come to me a while back worried authorities weren’t giving them the whole story about their loved one who was hit and killed by a car on a freeway exit ramp. As we retraced the victim’s steps, we found he’d been out drinking with friends. The establishment they were at illegally over-served the victim to the point he was dangerously intoxicated. While he responsibly decided not to drive home, he was unfortunately disoriented due to being over-served, and it led to him wandering off the walkway and into traffic.

In other words, what authorities wrote off as someone just being where they shouldn’t have been ended up being a complex example of a negligent alcohol provider breaking the law and contributing to someone losing their life. We were able to hold that establishment accountable where authorities may have overlooked them entirely and let them off the hook. I’m not suggesting something like that happened here, of course, but there could still be a lot more to this story than even authorities may realize. Ultimately, it will be up to the evidence to say one way or the other.
