Commentary by Attorney Michael Grossman

When it comes to motorcycle wrecks, I always have one concern: Are authorities being fair in their investigations? Simply put, a lot of folks are biased against motorcyclists. It’s not that motorcyclists never make mistakes, but many of them are responsible drivers. Jumping to conclusions isn’t going to help anything when there could always be extenuating circumstances a rider had little to no control over.

That’s why it can be frustrating when I get cases where it seems authorities didn’t see a motorcycle crash as worth their time and effort, or authorities were more focused on finding someone to blame than actually listening to the victim’s side of the story. It could be authorities here took time to consider electronic data, road conditions, signage and lighting, other drivers on the road, and other crucial factors that a proper accident reconstruction should include. However, if it took more thorough independent investigations to give that stuff the attention it needed, it would be far from the first time.
