Commentary by Attorney Michael Grossman
When a passenger vehicle collides with the back of a slowing 18-wheeler, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.
Why was the truck slowing down? Large commercial vehicles adjust their speed for many reasons, including traffic congestion, road conditions, or mechanical issues. Investigators should determine whether the truck was responding to normal traffic flow or if something unexpected caused it to slow down. Reviewing black box data, traffic camera footage, and road conditions at the time of the crash could provide important context.
Was the truck properly visible? Large trucks can be difficult to see, especially if their brake lights or reflective markings are not functioning properly. If the Kenworth’s lights were not illuminated or if its visibility was otherwise compromised, that could have contributed to the collision. Investigators should examine vehicle inspection records, lighting conditions, and crash scene evidence to determine whether visibility played a role.
Did the passenger vehicle driver have enough time to react? Safe driving requires maintaining a proper following distance, but even a careful driver can struggle to stop in time if the truck in front of them slows abruptly. Investigators should assess factors such as speed, sightlines, and whether distraction or fatigue may have played a role in the crash. Reviewing dashcam footage, cell phone records, and black box data could help clarify the sequence of events.
Did the trucking company play a role? Trucking companies are responsible for ensuring their vehicles are in proper working condition and that their drivers follow safety regulations. If this truck was experiencing a mechanical issue or was operating in a way that increased the risk of a collision, that’s something investigators need to uncover. Reviewing maintenance logs, safety records, and prior violations could provide insight into whether broader issues contributed to the crash.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
