Jacob Amesquita Alleged DWI Accident in Midland, TX

According to officials, 25-year-old Jacob Amesquita was on a Harley-Davidson motorcycle going northbound along Rankin. Passing West Francis, a southbound car reportedly failed to yield making a left turn, and Amesquita’s motorcycle crashed into the car. As a result, Amesquita sustained reportedly serious injuries. The other driver wasn’t injured.

Commentary by Attorney Michael Grossman

Authorities reported that they recommended a charge for DWI against the driver of the car. While that could make this seem like an open-and-shut situation, any crash involving alcohol can be very complex. That’s because a thorough investigation should include finding out where the driver got their alcohol from. If it’s found that a local bar, for example, illegally over-served the alleged drunk driver, they could be on the hook for their role in the accident. This could include criminal investigations, fines, license suspensions, and even liability for the victims’ injuries. Maybe that isn’t what happened in this crash, but considering authorities didn’t even mention looking into that possibility, my concern is something important could be slipping through the cracks here.
