Commentary by Attorney Michael Grossman
After any serious crash, it’s important to know exactly how thorough authorities are being in their efforts. Despite what people may think, authorities are not always equipped or otherwise motivated to get answers after a traffic accident. I can’t count how many times folks have come to me with reports that either overlooked important possible factors or outright jumped to conclusions without clear evidence.
For example, I handled a crash not long ago where a family was confused why authorities were saying their loved one wasn’t wearing their seatbelt. They always wore the seatbelt, so what was different here? Well, authorities completely overlooked the fact the victim’s seatbelt was defective. It failed to lock when the collision happened, so the victim suffered serious injuries that otherwise would have been prevented. Instead of having experienced accident reconstructionists with proper tools examine the victim’s vehicle, authorities simply jumped to conclusions and moved on.
I’m not saying anything so unusual led to this crash, but those are the kinds of possibilities investigations should at least be able to rule out. Otherwise, there’s no telling what possible factors could slip through the cracks. I see no reason right now why this crash would be an exception.
