Commentary by Attorney Michael Grossman

If it’s true that alcohol was a factor in this accident, it frankly wouldn’t be too surprising. Alcohol is almost always the reason behind someone getting on the wrong side of the road and getting into a serious accident. But as open-and-shut as that may seem, there could be more to this situation. Especially this early in the morning, my experience with hundreds of drunk driving accident cases has shown me that someone drunk enough to get on the wrong side of the road usually had help getting to that point from a negligent alcohol provider. Is that something investigators are looking into?

Simply put, alcohol providers who unlawfully over-serve obviously intoxicated persons can potentially face criminal investigations, fines, suspended licenses, and liability for resulting deaths or injuries. Too often, though, authorities get tunnel vision when focusing on the drunk drivers, and they let the complicit negligent alcohol providers slip under the radar. In my experience, families don’t want some bad guy to blame. They want to know they’re getting the full story, and they want to know there will be accountability for all responsible parties who wronged them. It remains to be seen if those steps are being taken here.
