Commentary by Attorney Michael Grossman
When crashes like this occur, people often assume they stem from a momentary lapse in judgment or an unavoidable accident. However, in my experience, incidents involving commercial trucks frequently involve multiple layers of contributing factors that demand careful investigation.
What circumstances led to the pedestrian being struck? Did the driver fail to notice the pedestrian due to distraction, fatigue, or other impairments? Was the truck traveling at a safe speed for the area, and were proper precautions being taken to account for visibility or other conditions? Equally important is understanding why the driver initially fled the scene. Was it a panic response, or were there deeper issues—such as potential violations or concerns over their legal exposure—that made them leave?
The trucking company’s role also warrants close scrutiny. Commercial drivers are expected to operate with a higher degree of caution and professionalism due to the nature of their work. Was the driver properly trained and monitored? Did the company ensure that the vehicle was properly maintained and equipped with technology, like cameras or sensors, that might have helped prevent the accident? These questions are critical to determining if negligence on the company’s part contributed to what happened.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
