Commentary by Attorney Michael Grossman

If the allegations about alcohol are true, the intoxicated driver may not be the only one responsible for these injuries. In Texas, alcohol providers may also have to bear the burden if their actions lead to people getting hurt.

Simply put, an alcohol provider who unlawfully over-serves someone who is obviously intoxicated may face criminal investigations, fines, suspended licenses, or liability for the injuries resulting from that intoxication. This means there are multiple avenues through which victims and families can see accountability for the harm done to them.

The challenge is actually ensuring those avenues are being considered. I can’t count how often I’ve had a case where we investigated a negligent alcohol provider, and authorities hadn’t even bothered conducting their own investigations. Perhaps authorities here haven’t been that shallow in their investigations, but I have yet to see enough information to believe they’re getting the whole story for those involved in this accident. .
