Commentary by Attorney Michael Grossman
While rear-end crashes like this may seem straight-forward, it can be troublesome when investigators treat them as such. It is true this sort of accident is usually just someone speeding, following too closely, or looking at their phone. But jumping to conclusions is bound to let something important slip through the cracks.
Was this a result of a mechanical defect? Poor road conditions? Was someone over-served by a bar? Was the rear driver in a work-related vehicle? Is this a particularly dangerous stretch of road due to poor design or a lack of proper signage? Likely or not, these things happen, and it’s important folks know their incident isn’t being swept under the rug just because investigators feel they have bigger problems to worry about.
