Commentary by Attorney Michael Grossman
With a serious truck wreck like this, it’s important to know whether or not investigations are being thorough enough. Victims and families often assume authorities are going to get them the answers they need. An accident this chaotic, though, could present unique challenges which authorities alone may not be able to handle.
Commercial truck accidents are not just big car accidents. They can involve all kinds of extenuating circumstances that require investigations to go beyond the surface-level details. Did either of the trucks have mechanical issues? Did a tire blow out due to a defect or poor maintenance? Was one of the drivers rushing to meet an unreasonable deadline? Were they within their hours of service limits? Are investigators pulling the trucks’ Engine Control Module data? Do either of the employers involved here have a history of drivers causing accidents? Did this involve some sort of medical emergency?
These are just some of the questions which I’ve repeatedly seen authorities completely overlook. Simply put, I’ve handled hundreds of commercial vehicle accident cases, many of which involved multiple commercial vehicles. Accidents this complex shouldn’t be left up to the chance that an officer may not be given enough time or equipment to do the job properly. That’s why it’s important folks consider avenues independent of the authorities so there are measures in place to prevent anything important from slipping through the cracks.
