According to officials, 33-year-old Humberto Escajeda was on foot at the time and ended up on eastbound lanes of Montana. Authorities did not say if the pedestrian was crossing or not. While there, an eastbound vehicle struck Escajeda, killing him. Right now, additional details about the accident remain unconfirmed.

People often see pedestrian accidents happening this early in the morning and just assume the victim was in the wrong. I can’t say what did or didn’t happen here, but it’s always important to consider the full context, since things are rarely ever that simple.

For example, I had a wrongful death case not long ago involving a pedestrian hit along the freeway. But it wasn’t a case against the vehicle driver; it was against a local alcohol provider. The man in that case had been out drinking with friends, and the establishment illegally over-served him. While he wisely decided not to get behind the wheel, he was unfortunately so intoxicated due to being over-served that he wandered into traffic lanes while trying to walk home.

If people just blamed that man without considering any other factors, there’s no telling if his loved ones ever would have learned the truth. Whether or not steps are being taken here to get all the facts remains to be seen.
