Commentary by Attorney Michael Grossman
A lot of people still look at rear-end collisions and assume they’re automatically open-and-shut. Like any serious accident, though, context matters. There’s no law saying a driver who rear-ends someone is automatically at fault. It’s important to know why it happened.
Were there poor road conditions? Did a vehicle defect play a role? Is this an unusually dangerous area for drivers? Was the truck slowing, turning, or stopped in the road? Were there any other vehicles involved that left the scene?
Likely or not, it’s important to know all the facts before rushing to judgment. I see no reason right now why this crash would be an exception.
