Commentary by Attorney Michael Grossman

If it’s true that intoxicated driving was involved here, it can present a serious challenge without the proper investigations. Obviously, a child crossing the road in this manner can be extremely dangerous. But it’s important to consider whether or not a sober driver would have been able to avoid hitting the child. People tend to just think pedestrian accidents are all about who had the right-of-way. However, if evidence shows that a driver should have been able to see and avoid the pedestrian, they would have a responsibility to do so, right-of-way or not. So was this supposed intoxicated driving the ultimate cause of this accident?
