Harris County, TX — April 19, 2024, Hermengildo Garcia was injured following an alleged drunk driver accident at around 6:30 p.m. along South Allen Genoa Road.

Preliminary information about the accident says that it happened off the corner of the South Allen Genoa Road and Pampa Street intersection.

According to authorities, 34-year-old Hermengildo Garcia was on foot and along northbound lanes of Allen Genoa. An approaching Kia Optima reportedly tried to pass a slower vehicle before striking Garcia. As a result, Garcia had reportedly serious injuries.

The Kia driver was accused of being under the influence of alcohol at the time. Harris County officials filed charges for intoxication assault. If those allegations are true, where did that alcohol from? If a bar, restaurant, or similar establishment over-served the driver, they may be subject to charges, as well.

Not a lot of people know about this area of the law, but alcohol providers in Texas can contribute to accidents like this through over-service of alcohol. Despite how common that is though, it’s not the sort of thing authorities pay much attention to.

I’ve handled hundreds of civil cases against alcohol providers responsible for contributing to serious accidents. Rarely did we find authorities conducting their own investigations into the alcohol providers. They usually only took action after we handed them evidence on a silver platter after our own investigations.

Harris County in general is more proactive with drunk driving accidents, but even they miss things. Hopefully that’s true here, as well, and they’re considering the possibility there’s an accomplice to all of this yet to be held accountable for their actions.
