A common point of confusion I address on this blog often is people tend to thing an accident involving an alleged intoxicated driver is open-and-shut. After all, authorities are blaming someone for something clearly unacceptable. But even if the allegations are true, there could be more to the story that authorities are overlooking.
For example, it’s important to know if alcohol was the specific intoxicant here. In Texas, alcohol can involve negligent alcohol providers who may also be responsible for an accident. Investigations may show that a negligent alcohol provider unlawfully over-served the drunk driver. Those alcohol providers can then be responsible for contributing to an accident resulting from that intoxication.
So as serious as it is to see someone facing charges here, that may only be the tip of the iceberg. It’s important for a victim’s loved ones to know investigations are being thorough enough to see that all whose actions contributed to the accident face appropriate consequences. Is that happening here?
