Montgomery County, TX — May 27, 2024, Heather Lupoli and Kevin Picard were injured due to an alleged drunk driver accident at around 5:45 p.m. along F.M. 2090.

According to officials, the accident took place in the area of F.M. 2090 and Daw Collins Road, west of Splendora.

Investigators say that 41-year-old Heather Lupoli and 43-year-old Kevin Picard were in an SUV along with three children. They were going westbound along F.M. 2090, and at Daw Collins, a southbound Toyota Avalon failed to yield. As a result, the Avalon and the SUV crashed. Lupoli reportedly had serious injuries while Picard and the children in the vehicle may have had minor injuries.

The Avalon driver was accused of being under the influence of alcohol. If that’s true, did authorities look into where that alcohol came from? If they were over-served by a bar, there could be a lot more to this story the victims need to know about. Unfortunately, that’s not often something authorities look into on their own.

For example, I handled a case a while back where a drunk driver hit a family’s car, seriously injuring a young child. The family wanted to know their options, but they were curious why we cared about where the drunk driver had been drinking, since it wasn’t something police ever mentioned. Well, our independent investigations showed the bar that served the drunk driver did so illegally. It recklessly over-served him until he could barely walk to and from the bathroom, let alone drive. Not only was that behavior something that made them responsible for the resulting injuries, it opened them up to potential criminal investigations, fines, and even license suspensions.

The authorities in that example simply didn’t feel it was worth the effort to go beyond holding the drunk driver accountable. Meanwhile, there was a local establishment who also broke the law they were letting off the hook. Had that family not thought to ask someone about their legal rights, there’s no telling if that establishment ever would have faced consequences for their actions. So while I can’t say what all happened here, there’s every reason to make sure investigators have been thorough. Accountability isn’t about finding someone to blame; it’s about ensuring all responsible parties face appropriate consequences.
