Commentary by Attorney Michael Grossman

There may not be an awful lot to say about this accident, except for hoping that TxDOT will fix the road hazard that seemingly triggered this crash during a simple passing maneuver. To make sure the whole story is found, though, it may be best to carefully examine the victim’s car for any malfunctions or defects. For example: If she braked on the way off the road, did the brakes engage properly? If not, why not? Did the car’s safety features work as intended and prevent the maximum amount of harm? Again, if not then why not?

Those questions and the many others like them aren’t meant to suggest that things must be more complex than they seem. I just know from long experience that many crashes really happen due to a lot of factors happening at once, yet investigators at the scene tend to latch onto the most obvious ones and leave everything else behind. A thorough investigation could find that the car should have responded better to the dip, or should have prevented more injuries during the crash—or it might find that it performed the best it could under the circumstances. The important thing is to know for sure, and that takes time and effort authorities aren’t always willing to invest. Will someone make sure the victim gets all the facts here?
