Right now, authorities allege that Miss De La Cruz was under the influence of alcohol. To be clear, I don’t say this to upset anyone, and it’s not even my place to say if it’s true. But this shopping center had businesses that sell alcohol. If the driver was coming from one of those business, did authorities investigate if they illegally over-served the driver and contributed to her injuries?
Whether it’s a bar, a restaurant, a liquor store, or a gas station, if a business contributes to someone’s injuries, they can face consequences such as civil liability, criminal charges, and fines and other penalties through the TABC. Despite this, however, police often will put all of the blame on the driver and move on without a second thought. So they have a lot to answer for, but a business that broke the law and contributed to a serious accident get off scot-free. Is that really just?
It’s not that drunk driving is ever excusable, but one person’s mistake doesn’t erase any of the wrongs that were done to them. It’s why accidents like the one described here (if the allegations are true) are worth attention just like any other serious accident. But whether or not it’s getting that attention isn’t clear to me based on these statements from the authorities.
