Commentary by Attorney Michael Grossman

When it comes to pedestrian accidents, investigations can be a lot more complex than folks may realize. Typically, people assume it’s all about who had the right-of-way, but things aren’t quite so simple. Investigators also have to consider if the victim was reasonably avoidable.

For example, if someone is in the middle of the road, but they’re clearly visible and far away enough to avoid, drivers have a responsibility to avoid them. They wouldn’t have some free pass to hit them just because they had the right-of-way. That’s why there needs to be a proper accident reconstruction to determine things like where the victim was, what visibility was like at the time, how fast the driver was going, and if a reasonably prudent and attentive driver would have been able to avoid the accident.
