Commentary by Attorney Michael Grossman

When a crash involves an allegedly intoxicated driver, most people assume the investigation ends once charges are filed. But if alcohol played a role here—as authorities suggest—then it’s important to ask a question that too often gets overlooked: Where did the alcohol come from?

In many cases like this, the intoxicated driver didn’t become impaired in isolation. More often than not, they were drinking at a bar or restaurant before getting behind the wheel. That matters because Texas law prohibits alcohol providers from serving people who are obviously intoxicated. When an establishment ignores that law and continues to serve someone who shouldn’t be drinking, they may share responsibility for a resulting crash.

If authorities are being thorough here, they should be looking into where the allegedly intoxicated driver was prior to the crash. Unfortunately, in my experience, authorities tend to move on once there’s someone facing charges. At the end of the day, victims and families deserve to see accountability for all wrongdoers who harmed them. Besides, if there is a negligent alcohol provider involved in this, they need to face consequences before their actions harm others.
