Commentary by Attorney Michael Grossman

When a single-vehicle accident results in a fatality, a thorough investigation is essential to determine how and why the crash occurred. In my experience, understanding the contributing factors in such cases requires careful attention to three critical questions.

First, did the authorities thoroughly investigate the crash? A vehicle veering out of its lane and striking a guardrail before losing control raises questions about what caused the driver to lose command of the vehicle. Investigators should analyze physical evidence such as tire marks, debris, and the vehicle’s final position to reconstruct the sequence of events. Witness statements or any available traffic camera footage could provide additional clarity, helping determine whether speed, distraction, or other external factors may have contributed.

Second, has anyone considered whether a vehicle defect might have played a role? Mechanical issues, such as brake malfunctions, steering failures, or tire blowouts, could prevent a driver from navigating an exit ramp safely. A forensic examination of the Nissan Altima is essential to identify or rule out any mechanical failures that may have contributed to the crash. Additionally, understanding whether the car’s safety systems, such as airbags and seat belts, functioned properly during the collision is critical to evaluating their role in the crash’s outcome.

Finally, has all relevant electronic data been collected? Modern vehicles like the Nissan Altima are typically equipped with event data recorders (EDRs) that can provide crucial information, such as speed, braking, and steering inputs leading up to the crash. This data can help clarify whether the vehicle’s movements were consistent with driver input or indicative of a mechanical failure. Nearby surveillance cameras or dashcam footage, if available, might also capture key moments leading up to the crash, offering insight into external conditions or other contributing factors.

Accidents involving severe outcomes, such as fatalities, require comprehensive investigations to uncover all contributing factors. By addressing these questions, investigators can work toward providing a clearer understanding of what happened and why. A thorough investigation is the least that can be done to ensure every possible factor is carefully examined. For the loved ones of Gerardo Gabriel Mendoza, obtaining these answers is an essential step toward clarity and closure.
