While exact circumstances here aren’t entirely clear, it’s important to understand some of the inherent challenges with pedestrian accidents. Folks tend to think it’s all about whether or not someone was in a crosswalk. But like any fatal accident, it’s important to consider the evidence and to understand the whole context of what happened.

For example, I handled a pedestrian case a while back where a man was hit on the freeway. His family found it odd the victim would have been in that situation and asked us to look into things. It turned out he’d been out drinking with friends, and the establishment they were at unlawfully over-served him to the point his intoxicated was a danger to himself. While he responsibly chose to walk home rather than put others in danger by driving, the intoxication made him disoriented. He accidentally wandered off the walkway and onto the freeway where the accident occurred.

What people no doubt just wrote off as someone being somewhere they weren’t supposed to be ended up being a local alcohol provider breaking the law and contributing to a man losing his life. That’s why pedestrian accidents need to be taken seriously. They’re not always so complex, but they very well could be. Families deserve to know they’re going to get the answers they need, regardless of what happened. Were authorities able to do that here?
