Commentary by Attorney Michael Grossman
These are really shocking details about a crash that happened really close to home. It’s encouraging authorities seem to have an idea of what happened and are taking some steps to address certain alleged mistakes. What I don’t see, though, is an explanation of why this happened. That can be a far more involved investigation than authorities alone may be able to handle.
I say this not to disparage the local department but because I’ve handled hundreds of commercial vehicle accident cases. They’re not just about finding out what the driver did wrong. More often than not, there are issues going on behind the scenes that a typical police investigation doesn’t dig into. Employment history, training records, maintenance logs, hours of service logs, company procedures for how to handle late deliveries, etc. Combine that with the complexity of examining a crash scene and inspecting vehicles for defects, and that’s a whole lot more than just looking at distracted driving or speeding.
That’s why it’s important to know early on what sort of time and resources authorities have been able to dedicate to the investigations. If they’ve been able to dig into all of these complex details and preserve evidence for the victim’s family to have going forward, that’s good. It’s just not the sort of thing I’d ever encourage folks to take for granted. At the very least, it’s prudent to follow up with authorities and make sure someone is asking all the right questions.
