It raises red flags that officials believe the truck being stopped in a lane of travel was a primary contributing factor in this crash. I have to wonder, though, if they’re looking into why this truck was parked in a lane of travel. Even if the truck driver did something wrong here, there may have been mistakes made long before they got behind the wheel that need to be called out.
For example, I handled a commercial vehicle accident case which also involved a truck stopped on a highway. Things were bad enough in that the truck driver never put out reflective cones or flares (as is required), leaving an unmarked multi-ton obstruction in the middle of the road. But what authorities missed, and what our independent investigations uncovered, was that the mechanical issue that caused the truck to breakdown was the result of months of neglected maintenance. Had the trucking company simply kept up with routine maintenance, the issue likely never would have occurred. Instead, they kicked the can down the road and inevitably caused a serious accident.
So what people may have written off as a single reckless truck driver ended up being a whole trucking company putting countless lives at risk every time they sent a truck out on the road. Calling out that kind of behavior is crucial not just for ensuring a family sees accountability for the wrongs done to them but also to help root out serious problems that might lead to accidents in the future. That’s why, as serious as these preliminary statements are, I have to wonder if there’s more to this story that still needs attention.
