According to officials, 61-year-old Frank Brooks was in a Dodge Ram going westbound along De Zavalla. The vehicle apparently went off the side of the road at a bridge. It then crashed into the end of the bridge guardrail. Brooks was fatally injured in the crash. There did not appear to be anyone else involved in the crash.

Commentary by Attorney Michael Grossman
I certainly don’t know more about this specific incident than what’s already public. However, it’s a glaring red flag anytime a fatal accident involves someone crashing into a guardrail. Simply put, there may have been a defect authorities are overlooking.
Over recent years, investigators have been finding more incidents which became fatal not due to the cause of the crash itself but because a guardrail was defective. Put simply, they’re supposed to deform on impact in such a way that the guardrail doesn’t pierce through the vehicle and hit anyone inside. Many rails, however, fail to do so, and they end up killing someone in an otherwise survivable crash.
Frankly, this is far from an ordinary possible factor to look into. Authorities rarely include it in their investigations, and even if they do, they rarely have the required tools to look into it properly. That’s why my concern in these situations is that important details will slip through the cracks unless there’s a thorough independent accident reconstruction involving specialists who can look into the possibility of a defective guardrail. Even just ruling it out can be crucial for a family who lost a loved one. At the very least, they deserve to know they’re getting the whole story.
