Commentary by Attorney Michael Grossman

I can’t shed any more light on what happened here based on the preliminary details. However, I always talk about how no serious crash is ever really simple. I don’t see why this one would be an exception. There’s just no telling what authorities may overlook in their initial investigations.

For example, I was just discussing an accident with a colleague that helps explain this. In that crash, a woman happened to be looking at her phone when she hit the back of a truck. Pretty open-and-shut, right? Well, it stood out that despite hitting the brakes and crashing at a relatively low speed, she still had serious injuries. An independent investigation found that was because she had a defective airbag. So regardless of what caused the crash, a defect caused her injuries.

Again, I’m not saying something like that happened here, though it is possible. My point is simply that public statements rarely tell the whole story. I’ve seen independent investigators catch all kinds of information authorities let slip by them—sometimes details which they usually don’t miss. At the end of the day, it’s about getting all of the evidence to speak for itself. Hopefully those steps are taken here.
