Commentary by Attorney Michael Grossman

When I see a report like this, my first thought is that I hope the injured driver and her family gets the answers they need about what caused this crash. While the report states that the two vehicles collided for unknown reasons, my experience tells me that these situations often warrant a closer look. To truly understand what happened, there are three critical questions that must be asked.

First, did the authorities thoroughly investigate the crash? Determining how and why two vehicles collided requires a detailed accident reconstruction. Investigators should consider factors like traffic signals, road conditions and whether either driver was speeding, distracted or impaired. Were there any witnesses who saw what happened? Did authorities measure skid marks, examine vehicle damage patterns or collect surveillance footage from nearby businesses? The depth of this investigation will determine how well authorities can explain what led to the crash.

Second, has anyone looked into the possibility that a vehicle defect caused the crash? Both vehicles involved were around a decade old, meaning mechanical failures — such as brake issues, unintended acceleration or steering malfunctions — could have played a role. If either vehicle experienced a sudden loss of control, that should be investigated. Unfortunately, vehicle defects are often overlooked because police departments don’t typically have the resources to conduct a forensic vehicle examination. If the vehicles are repaired or scrapped before an expert can inspect them, crucial evidence could be lost.

Third, has all the electronic data relating to the crash been collected? Both the Nissan Murano and Honda Civic are likely equipped with an engine control module (ECM) that may contain key data, such as vehicle speed, braking activity and steering inputs in the moments leading up to the crash. Additionally, any available traffic cameras, dashcams or nearby security footage could provide valuable insight. Cell phone records may also be relevant if distraction is a concern. Without this data, investigators are left with only part of the picture.

At the end of the day, crashes like this leave those involved with pressing questions. The least the community can do is ensure that every effort is made to uncover the full truth.
