Currently details allege that the Silverado driver was under the influence of alcohol at the time of the accident. If that’s true, did authorities also look into where the alcohol came from? People tend to think that drunk driving accidents are simple because it’s obvious someone did something wrong. But in many alcohol-related accidents, further investigations can show a driver was unlawfully over-served by an alcohol provider, and the provider could also be responsible for contributing to the crash.

Too often, though, this is something authorities overlook. For example, I had a case where a family had no idea a bar was involved in their wreck. Our investigations showed the bar illegally over-serve the drunk driver to the point he could barely walk to or from the bathroom, let alone drive. Their behavior was egregious and clearly in the wrong, which is why it surprised the family that authorities never even bothered mentioning it as a possible factor.

I’ve handled hundreds of cases against negligent alcohol providers, and stories like that are far and away the norm. That’s why accidents like this often need independent investigations on top of whatever police have looked into. Police here may have been more thorough, but taking that for granted only risks letting a wrongdoer off the hook for their role in a serious crash.
