Commentary by Attorney Michael Grossman
With such a serious crash, the scene is usually very chaotic, and it’s important investigators the time and tools it takes to keep all the facts straight and ultimately get the whole story. This is especially important in a state like California, which operates on what’s called pure comparative fault.
Essentially, accountability is apportioned appropriately to all parties involved in an accident. It could be that one person’s actions are entirely to blame. If could be that two drivers share half of the responsibility. Or, one driver may be more to blame than the other, but the law still holds the other driver accountable according to their own respective actions.
Considering the person killed here was a passenger who likely did nothing wrong, it’s important their loved ones know that all parties involved will be looked at closely and that any and all wrongs will be addressed fairly.
