A preliminary accident report indicates that a 2012 Ford F-150 was heading southeast on Rohde Road when it ran a stop sign and collided with a 2007 Peterbilt semi-truck, forcing the larger vehicle to hit a guardrail and overturn.
Truck driver Esmeregildo Javier Ramòn, 60, died from injuries suffered in the crash, according to the report.
The Ford driver, who was not injured, was charged with intoxication manslaughter with a vehicle after the crash, the report states.
Authorities have not released any additional information about the Hays County crash at this time.
How Did This Accident Occur?
As if commercial vehicle accidents were not complicated enough, the allegation that alcohol was a factor in this crash adds another layer to the investigation.
In addition to examining clues from the scene and vehicle data to determine how the crash unfolded, investigators should look into where the Ford driver had been drinking, if evidence proves he was intoxicated. Under Texas law, alcohol providers can be held responsible for anyone they served while they were visibly intoxicated.
I don’t know if that is what happened in this instance, but it is worth investigating so the victim’s family knows who should be accountable to his death.
