Commentary by Attorney Michael Grossman

I’ve been doing this job for over 30 years, and still the most common misconception I deal with is that someone who rear-ends another vehicle is automatically to blame. That’s simply not true.

To be clear up front, I have no idea right now one way or the other what caused this crash. I’m not here to speculate; on the contrary, I do my best to discourage people from jumping to conclusions just because they think an accident is straight-forward. It’s always important to make sure there are thorough investigations into the full context.

Were there issues with the roadway at the time? Was visibility limited beyond just being dark out? Did the 18-wheeler trailer have working taillights and brake lights? Was its blinker on? Has the victim’s vehicle been inspected for defects, such as with its brakes, tires, or even safety devices (seatbelts, airbags, crash avoidance) that could have made the crash worse? Have authorities pulled cell phone records and Engine Control Module (ECM) data from the vehicles? Have they looked at the nearby business to see if any security cameras caught the accident on video?

At the end of the day, it’s possible that nothing unusual happened here. However, I’ve handled hundreds of commercial vehicle accident cases. There are times when unusual or extenuating circumstances go unnoticed in the initial investigations, and it can take more thorough secondary investigations to get the whole story. If nothing else, families deserve to know they’re not missing anything important. Whatever possible resolutions there may be here, it all starts with getting the facts.
