Commentary by Attorney Michael Grossman
As open-and-shut as some accidents may seem, the cause of a crash is not always the only factor that needs attention. Sometimes, the cause of one’s injuries are significant. Let me explain what I mean by this.
The reason serious crashes need thorough investigations even when the cause of the crash seems clear is because there may have been extenuating circumstances beyond what’s immediately obvious. For example, I had a case not long ago where authorities treated a crash as open-and-shut. As a result, they overlooked something our independent investigations revealed: the victim had a defective seatbelt. Had the seatbelt worked properly, they likely would have been okay. Instead, the defect led to severe injuries.
I’m not saying that happened here, but I rarely see authorities look into potential vehicle defects after serious accidents. That’s why it’s often prudent to have a second set of eyes look over the details surrounding a crash. Even if it’s out of an abundance of caution, many people reasonably decide it’s better to be safe than sorry.
